These Terms of Use ("Terms") govern your access to and use of Willow's mobile application, website, guest upload pages, event galleries, QR-code and link-sharing features, highlight reels, and related services (collectively, the "Services"). By creating an account, accessing an event, uploading content, purchasing a plan, or otherwise using the Services, you agree to these Terms and to Willow's Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility and Accounts

You must be legally capable of entering into these Terms. Willow is not directed to children under 13, or to children under a higher minimum age where required by applicable law. Hosts may create an account using supported sign-in methods, which may include email/password or Google Sign-In. You are responsible for keeping your account credentials secure and for activity occurring through your account. You must provide accurate account information and may not impersonate another person, create an account using information you are not authorized to use, or attempt to gain unauthorized access to another account.

2. Hosts, Guests, and Viewers

Willow supports different ways of participating in an event: Hosts create and manage events, configure event settings, share QR codes or links, review submissions, and manage event content. Guests may access an event through a QR code or shared link and may be able to upload or view photos without creating a Willow account. Viewers may access approved event galleries, albums, or highlight reels when they have a valid event link or other authorized access. Event links and QR codes can provide access to event content. Hosts are responsible for deciding who receives them and should treat them as sharing credentials.

3. User-Generated Content

Willow allows users to upload photographs and other supported content ("User Content"). You retain any ownership rights you have in your User Content. By uploading User Content, you grant Willow a limited, non-exclusive, worldwide license to host, store, process, reproduce, display, transmit, resize, convert, and otherwise use that content only as reasonably necessary to operate, secure, improve, and provide the Services, including event galleries, moderation, downloads, QR-based sharing, and highlight reels. This license does not transfer ownership of your User Content to Willow.

4. Your Responsibilities for Uploaded Content

You are responsible for the User Content you upload or share through Willow. By uploading content, you represent that you have the rights, permissions, or other lawful authority necessary to upload and share it. You agree not to upload, post, transmit, or otherwise use the Services for content or activity that:

Users must exercise particular care when uploading photographs of children and should ensure they have appropriate authority or permission to share such content.

5. Acceptance of Content Rules

Where Willow presents an acceptance prompt before a user creates or uploads User Content, you must accept the applicable Terms or content rules before proceeding. Continuing to upload after accepting those rules confirms your agreement to comply with them. Willow may prevent uploads or access when required acceptance has not been provided.

6. Host Moderation

Hosts may be provided tools to approve, reject, hide, or remove photographs submitted to their events. A host's decision to approve content does not mean Willow endorses that content. Hosts are responsible for reasonably managing their events and should take appropriate action when they become aware of content that violates these Terms.

7. Reporting and Enforcement

Willow may provide tools for reporting photographs, users, devices, or activity that may violate these Terms. Willow may review reports and, when appropriate, remove or restrict content, block upload access, suspend or terminate accounts, limit devices or sessions, preserve information when legally required, or take other reasonable measures to protect users and the Services. Willow is not obligated to pre-screen every photograph before it is uploaded or displayed, but we may moderate content and enforce these Terms at our discretion and as required by applicable law.

8. Shared Albums, Downloads, and Privacy

Approved event content may be accessible to people who possess the applicable event link or QR code, depending on the event's settings. If another person legitimately accesses or downloads a photograph from an event, Willow cannot control what that person later does with the downloaded copy. Hosts and users should therefore share event links and QR codes carefully. Your use of Willow is also subject to the Willow Privacy Policy, which explains how personal information and uploaded content are processed.

9. Intellectual Property and Copyright

Willow does not claim ownership of photographs merely because they are uploaded to the Services. The Willow name, branding, logo, application design, software, website, interfaces, graphics, and other Willow-created materials are owned by or licensed to Willow and are protected by applicable intellectual-property laws. You may not copy, reproduce, reverse engineer, distribute, sell, sublicense, or create unauthorized derivative works from Willow's software, branding, or proprietary materials except where permitted by law. If you believe content available through Willow infringes your copyright or other intellectual-property rights, contact privacy@thewillowevent.com with enough information for us to identify and review the material.

10. Payments and Paid Plans

Willow offers a free trial and paid plans. Current prices, storage periods, event limits, and other plan benefits are published at www.thewillowevent.com/pricing and are shown at or before purchase. All prices are in US dollars (USD). Every paid plan is a one-time payment processed by Stripe (or another disclosed payment provider) through a hosted payment page; Willow does not receive or store your complete payment-card number or CVV. Willow does not currently offer automatically renewing subscriptions — Willow Pro is a one-time payment covering 12 months and ends unless purchased again. If Willow later offers automatically renewing subscriptions, the applicable renewal price, billing period, cancellation method, and any platform-specific subscription terms will be disclosed before purchase.

Refunds and cancellations are governed by the Willow Refund & Cancellation Policy (www.thewillowevent.com/refund-policy), which forms part of these Terms. In summary: unused Single Event, 2-Event Bundle, and Willow Pro purchases may be refunded in full within 7 days of purchase; once an event has received photos (or a Pro event has been created) the service has been delivered and the purchase is non-refundable; Storage Extensions are non-refundable once applied. Duplicate or erroneous charges are always refunded in full. Refund requests may be sent to support@thewillowevent.com.

11. Event Storage and Expiration

Willow events and uploaded content may be subject to storage or availability periods based on the selected plan. Current storage periods may differ between free and paid plans and should be reviewed at the time an event is created or a plan is purchased. Users are responsible for downloading and preserving any photographs they wish to keep before an event or storage period expires. Willow should not be treated as a permanent archival or backup service.

12. Account and Content Deletion

Registered users may delete their Willow account using the account-deletion functionality provided in the application. Willow also provides or will provide a web-based method for requesting account deletion. Deleting an account may remove or deactivate events, photo records, highlight-reel records, active sessions, and other associated application data, subject to legal, security, accounting, fraud-prevention, technical, and backup-retention requirements described in the Privacy Policy. Some copies already downloaded or saved by other users are outside Willow's control and cannot be deleted from those users' devices by Willow. 14. Service Availability and Changes

We may update, modify, suspend, discontinue, or replace portions of Willow as the service evolves. Features may change, and temporary interruptions may occur for maintenance, security, technical problems, or circumstances outside our reasonable control. We do not guarantee that every feature will always be available or that the Services will operate without interruption or error.

15. Suspension and Termination

You may stop using Willow at any time. Willow may suspend, restrict, or terminate access when we reasonably believe a user has violated these Terms, created security or legal risk, abused other users, repeatedly uploaded prohibited content, failed to pay applicable charges, or used the Services in a way that could harm Willow or others. Where appropriate, Willow may remove particular content instead of terminating an entire account.

16. Third-Party Services

Willow may rely on third-party providers for services such as authentication, infrastructure, object storage, email delivery, and payment processing. These providers may have their own terms and privacy policies. Willow is not responsible for independent third-party websites or services that are outside Willow's control.

17. Disclaimers

To the fullest extent permitted by law, the Services are provided on an "as is" and "as available" basis. Willow does not guarantee that the Services will be uninterrupted, error-free, completely secure, or that uploaded content will never be lost, corrupted, or unavailable. Users should maintain their own copies of important photographs and files. Willow is an event-sharing service and should not be used as the sole permanent backup of important content. Nothing in these Terms excludes warranties or rights that cannot legally be excluded under applicable consumer law.

18. Limitation of Liability

To the fullest extent permitted by applicable law, Willow will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, revenue, goodwill, or business opportunities arising from or relating to the Services. To the fullest extent permitted by applicable law, Willow's aggregate liability arising from or relating to the Services will not exceed the greater of (a) the amount you paid Willow for the Services during the 12 months immediately preceding the event giving rise to the claim or (b) US $100. These limitations do not apply where liability cannot legally be limited or excluded.

19. Indemnification

To the extent permitted by law, you agree to indemnify and hold Willow harmless from third-party claims, damages, liabilities, and reasonable costs arising from your User Content, your unlawful use of the Services, or your material violation of these Terms or another person's rights. This section does not apply to the extent prohibited by applicable consumer law.

20. Governing Law

These Terms are governed by the laws of the State of New Jersey, United States, without regard to conflict-of-law principles, except where applicable consumer-protection law requires otherwise. Any dispute that is not required by law to be brought elsewhere will be subject to the courts with appropriate jurisdiction in New Jersey. Nothing in this section removes rights you may have under mandatory consumer laws in your place of residence.

21. Changes to These Terms

Willow may update these Terms as the Services, business, or legal requirements change. When these Terms are updated, the "Last Updated" date at the top will be revised. If a change is material, Willow may provide additional notice through the app, website, email, or another reasonable method. Your continued use of Willow after updated Terms take effect constitutes acceptance of the updated Terms where permitted by law.

22. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law. These Terms, together with the Willow Privacy Policy and any additional terms presented for a specific paid plan or feature, form the agreement governing your use of the Services.
